“Fact finding” is a different sort of approach to settlement efforts. This process involves the neutral assisting the parties to determine and assemble the core facts in dispute. This is done by the neutral querying or investigating to discover what are the core facts, and helping determine the accuracy of the procured information or key issues in dispute. The neutral will help decipher these facts and issues and can assemble them in a report. The report may include recommendations. With this assistance the parties are hopefully able to cut through to the heart of their dispute. Depending on the parties’ preferences, the fact finder may then assist the parties in their ongoing discussions.
